By accessing or using Kodah ("Service"), operated by College Bros LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paid subscribers.

2. Description of Service

Kodah is an AI-powered social media management platform that enables users to create, schedule, and publish content across multiple social media platforms including Instagram, Facebook, LinkedIn, and X (Twitter). The Service includes AI content generation, analytics, and automation features.

3. Account Registration

• You must provide accurate, complete, and current registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to use the Service
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• One person or entity may not maintain more than one free account

4. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to publish spam, misinformation, or harmful content
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to harass, abuse, or harm others
• Scrape, reverse engineer, or copy the Service without permission
• Use automated means to access the Service beyond what is authorized
• Publish content that violates the terms of connected social media platforms

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of all content you create through the Service. By using the Service to publish content, you grant us a limited, non-exclusive license to process, store, and transmit your content solely as necessary to provide the Service.

5.2 Our Intellectual Property

Kodah, its features, AI models, branding, and all related technology are owned by College Bros LLC and protected by intellectual property laws. You may not use our trademarks without prior written permission.

5.3 AI-Generated Content

Content generated by our AI tools is provided as a starting point. You are responsible for reviewing, editing, and ensuring all published content complies with applicable laws and platform terms.

6. Third-Party Platform Compliance

When using Kodah to publish to social media platforms, you are also bound by those platforms' terms of service and community guidelines. We are not responsible for content rejected or removed by third-party platforms. You agree to use Kodah in compliance with:

• Meta's Terms of Service and Facebook Community Standards
• Instagram's Terms of Use and Community Guidelines
• LinkedIn's User Agreement and Professional Community Policies
• X (Twitter) Terms of Service and Rules

7. Subscription and Payment

• Paid subscriptions are billed monthly or annually as selected
• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• We offer a 14-day free trial for paid plans; no charge until trial ends
• Refunds are provided at our discretion and handled case-by-case
• We reserve the right to change pricing with 30 days notice

8. Cancellation and Termination

You may cancel your account at any time through your account settings. Upon cancellation:

• Your access to paid features ends at the current billing period's end
• Your content and data will be retained for 30 days, then deleted
• You can export your data before cancellation

We reserve the right to suspend or terminate accounts for violation of these Terms, with or without notice.

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE FOR YOUR PURPOSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLEGE BROS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless College Bros LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Louisiana.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
